Welcome to BoxTales. These Terms of Service (“Terms”) govern your use of the BoxTales website (boxtales.in), BoxTales hardware devices, and the Cultural Archive App (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

BoxTales is operated from India. These Terms are governed by the laws of India, including the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.

1. Definitions

• “BoxTales”, “we”, “us”, or “our” refers to BoxTales, operating from India.
• “Device” refers to BoxTales Kids or BoxTales Roots hardware products.
• “App” refers to the Cultural Archive App.
• “Content” refers to audio stories, recordings, and other media available through our Services.
• “User”, “you”, or “your” refers to anyone who accesses or uses our Services.

2. Pre-Orders

BoxTales devices are currently available for pre-order. By placing a pre-order, you acknowledge and agree to the following:

• Pre-order pricing is promotional and may differ from the final retail price.
• Estimated shipping dates (August 2026 for Kids, October 2026 for Roots) are approximate and subject to change due to manufacturing timelines.
• We will keep you informed of any changes to your estimated shipping date via email.
• You may cancel your pre-order and receive a full refund at any time before the order ships. See our Refund Policy for details.
• Early backer bonuses (bonus story cards or deity cards) are limited and subject to availability.
• Pre-orders are currently available for delivery within India only.

3. Pricing and Payment

• All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless otherwise stated.
• Payment is collected at the time of pre-order placement.
• We use PCI-DSS compliant payment gateways. We do not store your credit/debit card information on our servers.
• We reserve the right to modify pricing for future orders. Any price change will not affect existing pre-orders.

4. Shipping and Delivery

• We ship to addresses within India. International shipping will be announced at a later date.
• Shipping costs, if any, will be communicated at checkout. Early pre-orders may qualify for free shipping.
• Risk of loss passes to you upon delivery to the shipping carrier.
• You are responsible for providing an accurate shipping address. BoxTales is not liable for delays or non-delivery due to incorrect address information.

5. Use of Services

You agree to use our Services only for lawful purposes. You shall not:

• Reverse engineer, disassemble, or tamper with BoxTales hardware or software.
• Upload content that is illegal, obscene, defamatory, or infringes on the rights of others through the Cultural Archive App.
• Use the Services to distribute spam, malware, or any harmful content.
• Resell or commercially distribute BoxTales devices or content without our written permission.
• Attempt to access our servers, systems, or networks without authorisation.

6. User-Generated Content

When you record and upload stories via the Cultural Archive App:

• You retain ownership of your recordings and content.
• Recordings in your Family Vault remain private and accessible only to you and users you authorise.
• If you submit content to the Community Library, you grant BoxTales a non-exclusive, worldwide, royalty-free licence to host, distribute, and display the content to other users of the platform.
• You represent that you have the right to share any content you upload and that it does not infringe on the rights of others.
• We reserve the right to remove any content that violates these Terms or is flagged as inappropriate.

7. Intellectual Property

All BoxTales branding, device designs, website content, app interfaces, and pre-loaded audio content are the intellectual property of BoxTales or its licensors. You may not copy, reproduce, distribute, or create derivative works from our intellectual property without prior written consent.

Story cards and figurines are licensed for personal, non-commercial use. The audio content linked to each card is licensed, not sold, and remains the property of BoxTales or the respective content creators.

8. Warranty

BoxTales devices come with a 1-year limited warranty from the date of delivery covering manufacturing defects. This warranty does not cover damage caused by misuse, accidental drops beyond rated specifications, water damage, or unauthorised modifications. 9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, BoxTales shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific product or service giving rise to the claim.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in India. We encourage you to contact us first to resolve any issues amicably before pursuing formal legal action.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via our website and, where possible, by email. Continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
